Herrera to make a court appearance

City Attorney Dennis Herrera is scheduled appear in court Tuesday in the federal trial over the constitutionality of California's voter-backed ban on same-sex marriage.

 

Sanders, a Republican former police chief, had been opposed to same-sex marriage but reversed his position.

 

''I decided to lead with my heart ... and take a stand for equality and social justice,'' he said in 2007 during an emotional press conference in which he explained why he would not veto legislation approved by the San Diego City Council in support of same-sex marriage. Sanders also noted that the issue resonates with him personally: He has a lesbian daughter.

 

Herrera, who rarely has argued cases in court since he became city attorney eight years ago, personally asked Sanders to testify in the lawsuit seeking to overturn Proposition 8, the initiative approved by state voters in 2008 that prohibits same-sex couples from marrying.
