State owes district $100K judge rules

Kudos to City Attorney Dennis Herrera for getting the state to meet its financial obligations for student health services.

In May, Herrera filed a lawsuit accusing the state's Medi-Cal program of withholding reimbursements for more than $100,000 worth of medical services like eye exams through a defunct federal policy.

Medi-Cal had asserted that the policy allowed them to withhold the money because the services the San Francisco Unified School District provided its students were available for free in The City otherwise. 

According to Herrera's office, the act of withholding the money was through a federal policy that was invalidated in 2004.

Superior Court Judge Peter Busch today gave the state 60 days to decide whether to pay back the district with its own money or seek the money from the federal government, according to Herrera's office.
